Acceptance of Terms

By accessing and using DomAvail, you accept and agree to be bound by these Terms of Service. If you disagree with any part of these terms, you may not use our services.

What we provide to you

Description of Services

DomAvail provides the following services:

Important disclaimer about pricing data

Accuracy of Information

We refresh pricing data from registrar APIs every 24 hours. Between refreshes, prices and availability at the registrar may change. Promotional codes, currency conversions, and registrar-specific add-ons can also create differences between our display and the final checkout price.

What happens when you leave DomAvail

Third-Party Websites

When you click an affiliate link and leave DomAvail, you will be redirected to a third-party website (such as a domain registrar). Please be aware that:

  • β€’DomAvail has no control over and is not responsible for any purchases, transactions, or technical issues that occur on registrar websites
  • β€’We cannot guarantee the accuracy of pricing or availability after you leave our platform
  • β€’Any disputes regarding purchases must be resolved directly with the respective registrar
How you may use our tools

Acceptable Use

Our tools, including WHOIS Lookup and Bulk Domain Search, are provided for personal and professional use. By using these tools, you agree to:

  • β€’Use search and lookup tools for legitimate domain research and acquisition purposes only
  • β€’Respect documented rate limits (typically 60 requests per minute per IP for public endpoints; lower for bulk tools)
  • β€’Not use Bulk Search or WHOIS tools for automated data harvesting, competitive scraping, or commercial resale without written permission
  • β€’Respect rate limits and refrain from circumventing any access controls on our platform
How we earn revenue transparently

Affiliate Links Disclaimer

DomAvail contains affiliate links to domain registrars. When you click these links and make a purchase, we may earn a commission at no extra cost to you.

Our affiliate relationships do not influence our price comparisons or rankings. We are committed to providing unbiased, accurate information. Prices are refreshed every 24 hours from registrar APIs (see our Transparency Policy for the full methodology).

Protection of our content and trademarks

Intellectual Property

All content, trademarks, logos, and intellectual property on DomAvail are owned by or licensed to us. You may not:

  • β€’Copy, reproduce, or distribute our content without permission
  • β€’Use our trademarks or branding without written authorization
  • β€’Create derivative works based on our platform or content
Your responsibility for misuse

Indemnification

You agree to defend, indemnify, and hold DomAvail (and its operators, employees, and partners) harmless from any third-party claim, loss, or expense (including reasonable legal fees) arising out of: (a) your violation of these Terms; (b) your misuse of our services; or (c) your violation of any law or third-party right (including a registrar's terms of service) while using DomAvail.

Understanding our legal limitations

Limitation of Liability

DomAvail is provided 'as is' without warranties of any kind. We are not liable for any damages arising from your use of our services, including but not limited to domain purchase decisions based on our information. Your use of third-party registrar services is governed by their respective terms.

How disagreements are resolved

Governing Law and Disputes

These Terms are governed by the laws of the jurisdiction in which DomAvail is established, without regard to conflict-of-laws principles.

Before initiating any formal proceeding, both parties agree to attempt informal resolution by emailing [email protected] with subject 'Legal Notice'. If the dispute is not resolved within 60 days of that notice, either party may pursue available remedies before the competent courts of DomAvail's home jurisdiction.

Nothing in these Terms limits any non-waivable consumer rights you may have under the mandatory laws of your country of residence.

How you and we can end this agreement

Termination

By You

You can stop using DomAvail at any time. If you have an account, you can request its deletion by emailing [email protected] (subject 'Privacy Request'). See our Privacy Policy for retention details.

By Us

We may suspend or terminate your access to DomAvail without prior notice if you violate these Terms (e.g., automated scraping, attempting to bypass rate limits, or transmitting harmful code). For non-violations, we provide reasonable notice before any service-wide changes that affect availability.

What Survives Termination

Sections covering Limitation of Liability, Intellectual Property, Governing Law, and Indemnification continue to apply after termination.

How we handle updates to these terms

Changes to Terms

We reserve the right to modify these Terms of Service at any time. We will give at least 30 days' notice of material changes (defined as changes to your rights, the services we provide, or fees) via prominent notice on our website. Non-material updates (typo fixes, clarifications, link corrections) take effect immediately and are reflected in the 'Last Updated' date above. Continued use of our services after the notice period constitutes acceptance.

Standard legal provisions

Severability and Miscellaneous

Severability

If any provision of these Terms is found unenforceable, the remaining provisions remain in full force and effect.

Entire Agreement

These Terms, together with our Privacy Policy, Affiliate Disclosure, and Cookie Policy, constitute the entire agreement between you and DomAvail regarding your use of our services.

Force Majeure

We are not responsible for failure or delay in performance caused by events beyond our reasonable control, including natural disasters, war, acts of government, or third-party API/infrastructure outages.

Assignment

You may not assign or transfer these Terms or any rights under them without our written consent. We may assign these Terms in connection with a merger, acquisition, or sale of assets, with reasonable notice to users.

No Waiver

Our failure to enforce any provision of these Terms is not a waiver of our right to enforce it later.
